Please read this Terms of Service ("Terms", "Terms of Service", "Terms & Conditions") carefully before using the https://www.pikziy.com website operated by PikZiy is a(n) design agency formed in Pune, India ("us", "we", "our") as this Terms & Conditions contain important information regarding limitations of our liability. Your access to and use of our services are conditional upon your acceptance of project and compliance with these Terms. These terms apply to everyone, including but not limited to visitors, users, and others, who wish to access and use the services.
By accessing or using the our services, you agree to be bound by these terms. If you disagree with any part of the Terms, then you do not have our permission to access or use our services.
Our offers and pricing
We offer goods, services, and digital products at our agency. The price of these goods, services and digital products is customized based on your needs, which means that we will provide you with a quote after we determine your needs. This price does not include taxes or other payment gateway fees that you may be charged.
Effective Date
Any agreement will become effective on the date of the client’s acceptance of PikZiy’s Proposal.
Design Concepts
Within 5 business days of receiving your project confirmation, PikZiy will create proposed different design concepts for the requested collaterals. Concepts will be submitted for your review via E-mail. Upon receipt of your feedback on these designs, PikZiy will make any needed changes to your favourite of the proposed design concepts until you are completely satisfied. In case of unsatisfactory design concepts, PikZiy will revise the proposed number of revisions for the design concept. Further concept revisions will incur additional costs at PikZiy current hourly rate. Every project is bounded by a time limit of 14 Days or accordingly.
Iterations
In the event, the client makes any requests for additional work beyond the scope of the services set forth in the proposal, PikZiy will amend an additional fees or otherwise provide the client with a separate proposal for such additional work which will be mutually executed by the parties.
Deliverables
After the final approval of the design, The collaterals will be delivered to you as agreed in the proposal. Any further file format request will incur an additional fee as per PikZiy current hourly rate.
Co-operation
The client acknowledges and agrees that PikZiy timely and professional provision of the services are dependent and subjected at all times to the client’s cooperation and timely provision of all content and materials necessary for the completion of the services.
Ownership
You, the client, have ownership of the approved & delivered design collaterals, not the bounced design, for use in any media application that is beneficial to your business. PikZiy retains the ownership of all subscriptions, bounced designs and concepts and have the right to use any of the curated design, within printed and online portfolios, including promotional materials such as newsletters and advertisements. The client understands that it is the client’s responsibility to seek the copyright and trademark of the design. In the event of termination of this Agreement, PikZiy owns the design and has the right to complete, exhibit, and/or sell the design (not including the business name). The client understands that once the final invoice is paid in full, They have the right to use the design in all media useful for business promotion and that PikZiy reserves the right to display the design collateral for any business promotional use. The client also gives PikZiy permission to use the client’s full name, business address, and/or website address, for testimonial purposes on their website, or other business-related media.
Payment
In return for the design collaterals, the client agrees to pay 60% of the total fee payable as an upfront amount and balance of 40% of the total payable fee with an additional fee (if any) during the time of delivery. The client understands that the final designs ownership retains with the PikZiy until paid in full. We at PikZiy accept payments only via registered online payment gateway Razorpay or ClearOne. All the transactions are required to be made on Invoices generated by PikZiy through an online payment gateway shared over provided communication e-mail address only.
Expenses
The client will reimburse PikZiy for all reasonable expenses, as set forth PikZiy's invoice or as otherwise pre-approved by the client in writing.
Originality
PikZiy affirms that our designs are original and therefore owns the rights granted under this agreement and that the rights granted do not conflict or other agreements.
Delays
Illness, injury, or other events beyond PikZiy’s control, such as fire, theft, computer failure, and Acts of God may result in a delay of unpredictable length. Delays in approval will be the responsibility of the client. If the client does not approve or provide feedback within 3 days of the presentation, the assignment will be paused. And PikZiy is not bounded to charge 10% of the total payable fee to resume the assignment. If the invoice gets overdue by 7 Days, PikZiy is allowed to charge interest at the rate of 5% per week on the total payable fee on every new invoice generated as a late fee.
Subscriptions
Our agency features some products or services that are offered via a subscription model. A subscription model requires regular payments to receive a product or service. The initial term of the subscription is 6 months or 1 year depending on the plan the customer chooses.
We do not offer the option to revoke your subscription shortly after making your purchase.
Renewals
When you purchase a subscription on the website, your subscription will automatically renew on the due date of subscription session the customer chosen. We will automatically renew your subscription by using the payment method on file until you cancel your subscription.

Please note that you will no longer receive the items or services provided by the subscription on your cancellation effective date.
You must provide us with 7 day's notice prior to your automatic renewal date of your intent to cancel the automatic renewals for the cancellation to be effective.
Term
This Agreement will become effective on the Effective Date and continue until terminated by either Party as set forth herein.
Termination for cause
Either Party may terminate this Agreement in the event the other party is in material default of this Agreement and fails to cure such default within 7 days following written notice of the default by the non-defaulting Party.
Termination without cause
Either Party may terminate this agreement upon 7 days following written notice to the other Party. Upon termination by Client as set forth in this section, Client will pay to all Fees and expenses incurred for Services performed by PikZiy prior to the effective termination of this agreement.
Performance Liability
PikZiy does not warrant that the functions supplied by design(s), consultation, or advice, will be uninterrupted or error-free. The entire risk as to the quality and performance of the logo is with the client. In no event will PikZiy be liable to the client or any third party for any damages, including any lost profits, lost savings, or other incidental, consequential, or special damages arising out of the reproduction of, or appearance of the logo, even if PikZiy has been advised of the possibility of such damages.
Shipping
When you purchase our goods & services, either we or a third party will ship these goods to you. If a third party is used for shipping, the shipping will be governed by that third party’s Terms of Service and other applicable policies. Please contact us to gain access to the third party’s identity and policies. When you purchase our goods, the cost of the shipping will be calculated and presented to you during the checkout process.
We or a third party will ship the goods to you within a reasonable time from the date that you made your purchase.
Accounts
When you create an account on our Website, you guarantee that you are 18 years of age or older and that the information that you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on the Website. You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password, whether your password is with our Website or a third-party service. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
We reserve the right to terminate your account anytime at our sole discretion. You can terminate your account by contacting us or through their account on the Website.
Discretion
The client agrees not to disclose any information about the PikZiy to any competitor or similar business or person belonging to a similar business. If done, PikZiy can take legal action and is allowed to charge a penalty to the client.
Changes to terms of service
We reserve the right to make changes to these Terms of Service at any time. We will notify you immediately of making any changes to these Terms of Service via posting the updated terms of service to this website.
